Apple has appealed a decision to ban imports of its watches after President Joe Biden’s administration declined to veto the measure in government court. The tech giant has filed an emergency request to halt the ban and has asked the Federal Circuit to suspend the ban until the U.S. Customs and Border Protection determines whether a redesigned version of the company’s watch infringes Masimo’s patents. According to Apple, the customs will make a decision on January 12th. Masimo accused Apple of stealing pulse oximetry technology to incorporate into the popular Apple Watch. An order from the U.S. International Trade Commission (ITC) prohibits the import and sale of Apple Watches that use technology to read blood oxygen levels. After consultations, U.S. Trade Representative Katherine Tai has decided not to lift the ban. An Apple spokesperson confirmed that the company has appealed the ban to the Federal Circuit Court of Appeals in Washington. Masimo’s claims in California federal court ended in a mis-trial in May. No presidential administration has vetoed an ITC ruling since 2013. Apple’s wearables, home and accessories business brought in $8.28 billion in revenue in the third quarter of 2023.
