New Jersey Data Center Slapped with $1.1 Million Fine for Violating Clean Air Act
A recent incident has led to DataOne, the operator of a major data center on the East Coast, being fined $1.1 million by New Jersey for illegally installing and running gas generators in violation of the state’s Clean Air Act.
The fine comes after an investigation in August by The Guardian and Floodlight News, which revealed that DataOne was operating 45 out of 62 gas generators well above the state limit without the necessary permits. These generators emit harmful pollutants that can lead to health issues such as asthma and heart attacks.
New Jersey Department of Environmental Protection (DEP) officials emphasized the importance of regulating gas generators due to their environmental impact. DEP Secretary Ed Potosnak described the enforcement action as the largest ever taken against a data center in New Jersey.
Despite the significant fine, DataOne has 45 days to either apply for permits or cease operations. However, the company can continue running its gas generators during this period. Local environmental group Sustain SJ expressed dissatisfaction with the enforcement, calling for immediate suspension of operations until permits are obtained.
In a statement to the New York Times, a DataOne spokesperson stated that the company plans to apply for permits for temporary generators. They also mentioned a transition to low-emission fuel cells in the future.
